1. INTRODUCTION

Welcome to Cape & Whiskers (“we”, “our”, “us”). These Terms of Service (“Terms”) govern your use of our website and services. By placing an order or using our services, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our services.

2. ELIGIBILITY

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use our services and place orders. By using our services, you represent that you meet this requirement.

3. OUR SERVICE

Cape & Whiskers provides a service that transforms pet photographs into AI-generated artwork, which can then be purchased as physical printed products. You upload a photo of your pet, our AI generates a stylised portrait, you preview the result, and if satisfied, you can order it as a printed product.

All products are custom-made to order using your specific photographs. Each item is unique and produced specifically for you by our fulfillment partner.

4. ORDERS & PAYMENT

• All prices are displayed in the currency shown at checkout and include applicable taxes unless otherwise stated.
• Payment is processed securely by Stripe. We do not store your card details. By completing a purchase, you also agree to Stripe's terms.
• We reserve the right to refuse or cancel orders that fail fraud screening, contain prohibited content, or cannot be fulfilled.
• An order confirmation email does not constitute a binding contract until your order enters production.

5. INTELLECTUAL PROPERTY

Your Uploaded Content

You retain all rights to the photos and images you upload. By uploading, you grant Cape & Whiskers a limited, non-exclusive licence to use your images solely to generate your AI artwork and fulfill your order. We will not use your pet photos for any other purpose, including AI model training.

AI-Generated Artwork

The artwork generated for your order is created using AI image generation models. Under current US copyright law, AI-generated content without sufficient human authorship may not be eligible for copyright protection. We make no warranty that the generated artwork is eligible for copyright registration.

We grant you a personal, non-exclusive licence to use the delivered artwork and physical products for personal, non-commercial purposes. You may display, gift, and enjoy your purchased products freely. Commercial resale of the AI-generated artwork (separate from the physical product) is not permitted without our prior written consent.

Our Content

The Cape & Whiskers brand, logo, website design, and original content are our property or licensed to us. You may not copy, reproduce, or distribute our branding or website content without permission.

6. ACCEPTABLE USE

You agree not to upload:

• Images of people without their consent
• Content owned by third parties that you do not have rights to use
• Content depicting illegal activity
• Offensive, hateful, or abusive material
• Content that impersonates real people or brands

We reserve the right to refuse or cancel any order that violates these guidelines.

7. SHIPPING & RETURNS

Shipping and return policies are detailed in our Shipping Policy and Refund Policy, which form part of these Terms.

8. DISCLAIMER OF WARRANTIES

AI-generated artwork is provided “as is.” We do not guarantee specific artistic outcomes, exact colour matching between screen previews and printed products, or that generated artwork will perfectly replicate your pet's likeness. Minor variations in colour, style, and artistic interpretation are inherent to AI-generated art and the printing process.

We provide a free preview of your generated portrait before purchase so you can make an informed decision.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Cape & Whiskers shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of our services. Our total liability for any claim arising from an order shall not exceed the amount you paid for that order.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited by law.

10. YOUR CONSUMER RIGHTS

Nothing in these Terms affects your statutory rights as a consumer. EU consumers retain all rights granted by the mandatory laws of their country of residence, including the 2-year legal guarantee under the Sale of Goods Directive (2019/771). UK consumers retain equivalent protections under the Consumer Rights Act 2015.

11. PRIVACY

12. DISPUTE RESOLUTION

13. GOVERNING LAW

These Terms are governed by and construed in accordance with applicable law. Consumers in the EU and UK retain all rights granted by the mandatory laws of their country of residence, regardless of governing law.

We may update these Terms from time to time. Material changes will be communicated via email to registered users or by a notice on our website. Continued use of our services after changes constitutes acceptance of the updated Terms.
